accessing or using Ulinzinga, you agree to be bound by the following terms and conditions:

1. Acceptance of Terms
By accessing and using Ulinzinga, you accept and agree to be bound by these Terms and our
Privacy Policy. If you do not agree to these Terms, you must not use our services.

2. User Responsibilities

2.1 Account Creation:
You must create an account to access certain features of Ulinzinga. You agree to provide
accurate, current, and complete information during the registration process and to update such
information to keep it accurate, current, and complete.

2.2 Account Security:
You are responsible for maintaining the confidentiality of your account information and for all
activities that occur under your account. You agree to notify us immediately of any
unauthorized use of your account.

2.3 Prohibited Conduct:
You agree not to engage in any of the following prohibited activities:
- Posting or sharing content that is illegal, harmful, threatening, abusive, harassing,
defamatory, vulgar, obscene, or otherwise objectionable.
- Impersonating another person or entity, or falsely stating or otherwise misrepresenting
your affiliation with a person or entity.
- Engaging in fraudulent activities or schemes.
- Distributing viruses, malware, or any other harmful software.
- Attempting to interfere with, compromise the system integrity or security, or decipher any
transmissions to or from the servers running the service.

3. Payment and Tokens

3.1 Token Purchase:
Users can purchase tokens to access content on Ulinzinga. One token is equivalent to one
Malawian Kwacha (MWK).

3.2 Non-Refundability:
Tokens once purchased cannot be converted back to money or refunded.

3.3 Payment Methods:
We accept various payment methods, including Visa and MasterCard for payments made
outside Malawi jurisdiction. All payments must be made in Malawian Kwacha, and any
necessary currency conversions will be processed at the time of payment.

3.4 Dispute Resolution:
If you encounter any issues with payments or tokens, please contact our support team for
assistance.

4. Intellectual Property

4.1 Content Ownership:
Users retain ownership of the content they upload to Ulinzinga. By uploading content, you grant
Ulinzinga is a worldwide, non-exclusive, royalty-free license to host, display, and distribute your
content. This license terminates when the content is deleted by the user, except for content
already purchased by other users and for backup copies maintained for legal compliance.

4.2 Copyright Infringement:
We respect the intellectual property rights of others and expect our users to do the same. If you
believe your copyrighted work has been infringed, please notify us in accordance with our
Copyright Policy.

5. User Content Deletion

5.1 Deletion Rights:
Content creators have the right to delete their content from Ulinzinga at any time. Once
deleted, the content will no longer be accessible to other users.

5.2 Effects on Purchased Content:
If a content creator deletes content that has already been purchased by users,
those users will immediately lose viewing access, as the owner of the content holds the rights to it.

5.3 Ownership After Deletion:
Deleting content does not affect the creator's ownership rights. However, Ulinzinga retains a
non-exclusive, royalty-free license to maintain a backup copy of the deleted content for legal
and compliance purposes, as required by law.

6. Liability Limitation

6.1 No Warranty:
Ulinzinga is provided on an ‘as is’ and ‘as available’ basis. We do not warrant that the service
will be uninterrupted, error-free, or free of viruses or other harmful components.

6.2 Limitation of Liability:
To the fullest extent permitted by law, Ulinzinga shall not be liable for any indirect, incidental,
special, consequential, or punitive damages, or any loss of profits or revenues, whether
incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses,
resulting from:
- Your use or inability to use the service.
- Any unauthorized access to or use of our servers and/or any personal information stored
therein.
- Any interruption or cessation of transmission to or from our service.
- Any bugs, viruses, trojan horses, or the like that may be transmitted to or through our
service by any third party.
- Any errors or omissions in any content or for any loss or damage incurred as a result of
the use of any content posted, emailed, transmitted, or otherwise made available through
the service, whether based on warranty, contract, tort, or any other legal theory, and
whether or not Ulinzinga has been advised of the possibility of such damages.

7. Governing Law
These Terms shall be governed and construed in accordance with the laws of Malawi, without
regard to its conflict of law principles. Any disputes arising from or relating to these Terms or
your use of Ulinzinga shall be subject to the exclusive jurisdiction of the courts of Malawi.

8. Changes to Terms
We reserve the right to modify or replace these Terms at any time. If a revision is material,
we will provide at least 30 days’ notice prior to any new terms taking effect.
What constitutes a material change will be determined at our sole discretion.
Your continued use of Ulinzinga after the revised Terms take effect signifies your acceptance of the new Terms.

9. User Content and Conduct

9.1. User Content:
Users are responsible for the content they upload and must ensure it does not violate any laws
or infringe on the rights of others. Ulinzinga is not liable for any user-uploaded content.

9.2 Content Moderation:
Ulinzinga reserves the right to remove or restrict access to any content that violates these
Terms or is deemed inappropriate at our sole discretion.

10. Subscription Services

10.1 Subscription Plans:
Content creators can offer subscription plans to users.
The terms and pricing of these plans will be clearly communicated on the creator’s profile.

10.2 Subscription Payments:
All subscription payments are final and non-refundable. Users agree to the terms of each
subscription plan they subscribe to.

10.3 Subscription Cancellation:
Users may cancel their subscriptions at any time, but no refunds will be provided for the
remaining period of the subscription.

11. Content Creator Responsibilities

11.1 Compliance:
Content creators must comply with all applicable laws and regulations, including but not limited
to tax obligations.

11.2 Earnings and Payouts:
Creators are entitled to receive earnings from their content as specified in our payout policy.
Payouts will be processed as per the agreed schedule.

11.3 Content Standards:
Creators must ensure their content meets the community standards and does not contain
prohibited material.

12. Privacy and Data Protection

12.1 Data Collection:
We collect and process personal data in accordance with our Privacy Policy. By using
Ulinzinga, you consent to such processing.

12.2 Data Security:
We implement appropriate security measures to protect your data. However, we cannot
guarantee absolute security.

13. Dispute Resolution

13.1 Arbitration:
Any disputes arising out of or relating to these Terms or Ulinzinga shall be resolved through
binding arbitration in accordance with the arbitration rules of [Arbitration Institution], rather than
in court.

13.2 Class Action Waiver:
You agree to resolve any disputes with Ulinzinga on an individual basis and waive your right to
participate in a class action lawsuit or class-wide arbitration.

14. Miscellaneous

14.1 Entire Agreement:
These Terms constitute the entire agreement between you and Ulinzinga and supersede any
prior agreements or understandings.

14.2 Severability:
If any provision of these Terms is found to be unenforceable or invalid, the remaining

those rights.
